Welcome to I AM BODHI.

The terms “we”, “us” and “our” refer to I AM BODHI, a sole proprietorship operating from Hong Kong SAR.

I AM BODHI operates this store and website, including the related information, content, features, tools, products and services (the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when accessing or using our Services.

By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms excludes or restricts any statutory consumer rights that cannot lawfully be excluded or restricted.

We make reasonable efforts to display and describe our products accurately.

However, colours and product appearance may vary depending on your device, screen settings, lighting and other factors.

Product packaging, presentation or other minor characteristics may occasionally differ from photographs displayed on our website.

Product descriptions, availability and specifications may be updated from time to time.

We reserve the right to discontinue products or limit the quantities available to purchase.

Nothing in this section affects your statutory rights where a product is faulty, damaged, misdescribed or otherwise does not conform to applicable consumer law.

SECTION 3 – ORDERS

When you submit an order, you are making an offer to purchase products from I AM BODHI.

An order is accepted when we confirm acceptance of the order. We reserve the right to decline or cancel an order where reasonably necessary, including because of product availability, payment problems, suspected fraud, incorrect pricing or other errors.

If we cancel an order after payment has been taken, we will refund the relevant amount.

Please review your order carefully before submitting it. If you wish to change or cancel an order, contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled once fulfilment has begun.

Returns, refunds and cancellations are also subject to our Refund Policy and any mandatory rights available to you under applicable consumer law.

Unless otherwise agreed with us, products purchased through our normal retail store are intended for personal or household use and not for commercial resale.

Wholesale purchases may be subject to separate terms agreed between I AM BODHI and the wholesale customer.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change from time to time.

The price applicable to your purchase will be the price displayed when you place your order, subject to correction of obvious pricing or technical errors.

Shipping charges and any applicable taxes or other charges will be shown during checkout where applicable.

Depending on your location, your order may also be subject to customs duties, import taxes or other charges imposed by local authorities. Where these are not collected by us at checkout, you may be responsible for paying them.

You agree to provide accurate and complete payment and account information.

You confirm that you are authorised to use the payment method provided for your purchase.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times shown on our website or during checkout are estimates unless we expressly state otherwise.

We will make reasonable efforts to fulfil and dispatch orders promptly.

We are not responsible for delays caused by circumstances outside our reasonable control, including postal or courier disruption, customs processing, severe weather or other external events. This does not affect any rights you may have under applicable consumer law.

For consumer orders, responsibility for the goods remains with I AM BODHI until the goods are delivered to you or to a person identified by you to receive them, except where you independently arrange delivery using a carrier that we did not offer.

The Services and their content, including the I AM BODHI name, branding, logos, text, photographs, graphics, illustrations, product imagery, video, audio, designs and website content, are owned by or licensed to I AM BODHI and are protected by applicable intellectual property laws.

Unless expressly permitted by us or by applicable law, you may not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our content without our prior written permission.

Nothing in these Terms grants you ownership of or a licence to our intellectual property except as expressly stated.

Shopify's names, logos and other intellectual property belong to Shopify or its respective licensors.

We do not necessarily control or monitor these third-party services and their use may be subject to separate terms and privacy policies.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

I AM BODHI is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our Store are made directly with I AM BODHI.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and I AM BODHI, including any injury, damage or loss resulting from purchased products and services.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions with I AM BODHI.

Nothing in this section affects rights that cannot lawfully be excluded.

You grant I AM BODHI a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and adapt that Feedback for purposes connected with operating, improving and promoting our business and Services, subject to applicable law.

You must not submit content that infringes another person's intellectual property, privacy or other rights or that is unlawful, defamatory, abusive or malicious.

Any warranties, guarantees or conditions that cannot lawfully be excluded remain unaffected.

Nothing in this section affects mandatory consumer rights available to you under applicable law.

To the fullest extent permitted by law, I AM BODHI will not be liable for indirect or consequential losses that were not reasonably foreseeable when the contract between us was formed.

We are not responsible for losses resulting from your misuse of the Services or circumstances outside our reasonable control, except where applicable law provides otherwise.

Nothing in this section requires a consumer to indemnify us for matters for which liability cannot lawfully be imposed on the consumer.

The remaining provisions will continue in effect.

Subject to any rights you may have under applicable consumer law to bring proceedings elsewhere, disputes arising from these Terms will be subject to the jurisdiction of the courts of Hong Kong SAR.

Changes will not retrospectively remove or reduce rights relating to orders placed before the changes took effect where applicable law prevents us from doing so.
